Sažetak
One of the objectives of the EU Single Market Strategy adopted in 2015 is to enable Europeans to work wherever they choose in the EU. To fulfill this objective and to make it easier to exercise the freedom to provide services and freedom of establishment, the professional qualification recognition has to be guaranteed. When a profession is regulated in the EU country of destination, professionals with equivalent qualifications from another EU country may need to get those qualifications recognized before they can start working there. The European Professional Card (EPC) is created to help in this process. The European Professional Card was introduced by the Directive 2013/55/EU which amends the Directive 2005/36/EC on the recognition of professional qualifications. Directive 2013/55/EU introduces a common framework for training (CTF) which provides automatic recognition on the basis of accepted minimum common set of knowledge, skills and competencies required to perform a certain profession. The directive promotes the ECTS system (European Credit Transfer and Accumulation system) and introduces the possibility of expressing the duration of program in ECTS credits within the program as defined in Directive 2005/36/EC which acquired qualifier necessary for dealing a regulated profession. The introduction of the European Professional Card is one of the major achievements of the Directive 2013/55/EU. It was created to provide a system of recognition of professional experience and to promote automatic recognition of this experience across the EU as the response for different obstacles to the core principles of the Single Market for services that traditionally exist within the territory of different member states. In 2015 the European Commission adopted the implementing regulation to introduce the European Professional Card for the first five professions: general care nurses, physiotherapists, pharmacists, real estate agents and mountain guides who were selected among those having expressed an interest, following thorough consultations with stakeholders and Member States. Authors in the paper analyze the current situation within the European Union Single Market for services and possibilities for professionals to go cross border with no obstacles including the analysis of the European Court of Justice judgments as an important source of the EU law. The result of this analysis will give the answer on actual value of the European Professional Card for the business practice.
