Sažetak
The aim of this doctoral dissertation is to detect trends in the formation of extended term-embedding collocations, extended term-forming collocations and extended multinomial expressions. This dissertation thus suggests that the Sinclairian wider-context-perspective may yield useful results for the study of these units since it helps us to reveal the typical behaviour of a unit in terms of its usage in context. The research is conducted by means of comparable corpora consisting of original English and Croatian sample contracts, with both corpora downloaded from authentic legal sources. The interpretation of the extracted units is carried out by consulting legal dictionaries, literature on contract law, relevant case and statute law as well as various Internet sources discussing the meaning of a certain unit or its part. The dissertation also proposes approaches to the translation of extracted extended units of meaning and suggests that building lists of such units based on the nodes chosen to represent close equivalents in two comparable corpora may produce equivalent patterns in two unrelated legal systems. Very often, however, it is difficult to produce a naturally sounding phraseological unit in the target language due to the fact that the target language does not contain a similar pattern, and when it does, its collocational behaviour is different. Sometimes, extending an already extended unit of meaning helps us figure out the closest functional pattern in the target language (e.g. payment in full of the consideration payable under this contract – isplata u cijelosti kupoprodajne cijene iz ovog ugovora/isplata cjelokupne ugovorene cijene), whereas in some cases the corpus data fail to reveal the equivalent pattern in the target language. It is then up to the translator to create a target text pattern, but they need to be aware of the pitfalls such pattern might produce in the target text. For this reason, it is advised to advocate the application of international contract principles and preference of non-state law in the case of international contracts between common law and civil law (Moss 2007).
