Sažetak
The author is discussing a controversial issue of whether consumers might benefit from overriding mandatory provisions through the mechanisam in Article 9 of the Regulation (EC) No 593/2008 of the European Parliament and of the Council of 17 June 2008 on the law applicable to contractual obligations (Rome I). She arguments the affirmative opinion, inter alia, by stating that legal characterisation of such a provision is possible even if party protection is its aim provided that it also aims at safeguarding a public interest. These two aims, which according to the author, are not mutually exclusive.
