Sažetak
The paper discusses the possibility of introducing the doctrine doli incapax in Croatian juvenile justice system for children who have realized the essence and the characteristics of the (serious) criminal offence at the age of 10-14 years, if discernimento is established in such cases. In these cases, juvenile justice system should be applied, but it does not necessary means, the severe punishment should be imposed. Current legal provisions do not allow application of juvenile justice system on children under the age of 14 who have realized the essence and the characteristics of the (serious) criminal offence.
