Sažetak
The paper deals with the criminal law and medical aspects of the sudden infant death syndrome, in accordance with national regulations, compared with the theory and jurisprudence of law developed countries. In the first part of the paper, the concept and characteristics of the sudden infant death syndrome have been clarified and a brief historical review is given. Etiological dimension has been pointed out considering that the most common causes leading to sudden infant death syndrome include prenatal and postnatal risks. Although there are no legal solutions in Serbia to regulate cases of sudden infant death syndrome, presented is the national legislative framework, especially in cases of suspicion of the criminal offence of infant homicide. An overview was also made of the cases of sudden infant death in practice. The paper also contains an analysis of the legal procedure of determining the cause of the death of a newborn. Given that the exact causes of sudden infant deaths are still unknown, the role of parents' prevention and education is very important, as stated in the concluding observations.
