Sažetak
The lease contract quickly spread in the contemporary international practice because it offers financial advantages comparing to other methods of financing. In most of countries of the European Union, the lease contract is still classified as unspecified contract of autonomous commercial law and there are small number of laws that specifically regulate it. The necessity for increased legal protection of the parties in contracts in transition's countries has brought to legislative action, which resulted with laws that produced this contract as special commercial law contract. In this paper authors compare the legal provisions of the Croatian and Serbian national legislation concerning lease contract, which defined leasing contract as business and the rights and obligations of the contact's parties.
