Sažetak
EU approach to parallel procedures, embodied on mutual trust doctrine is a cornerstone of this presentation. Regulation 1215/2015, as the only one in the EU private international law system with a provision on third country lis pendens is presented. Further on presentation deals with the legal lacuna on a situation where a procedure among the same parties and the same cause of action is first initiated before the courts of a non Member State of EU. Such lacuna at the moment exists in relation to other EU private international law regulations: 2201/2003, 4/2009, 650/2012, as well as the Brussels Ia recast proposal. Diverging practice among Member States are pinpoined. National case law proves that the area is controversial and Member States’ courts follow two different approaches. In some Member States, the ongoing third state procedure is respected. In other cases, due to the Owusu v Jackson judgement and the exclusive nature of the EU jurisdictional rules, the procedure is ignored.
