Sažetak
Until the Consumer Protection Act from year 2003 entered into force, the right of early repayment had been regulated only with a few provisions of the Obligations Act. Although the Consumer Protection Act which was then in force regulated the right to early repayment as one of the rights of the consumers, a proper change in this regard followed the implementation of Directive 2008/48/EC on credit agreements for consumers and repealing Council Directive 87/102/EEC. That was a reason why the new Consumer Credit Act was adopted, which entered into force on January 1, 2010. This paper reviews all changes of legislation regarding the regulation of the early repayment as well as the changes which shall follow the implementation of Directive 2014/17/EU on credit agreements for consumers relating to residential immovable property and amending Directives 2008/48/EC and 2013/36/EU and Regulation (EU) No 1093/2010. Overview of the legislation changes and pointing out of the results of the empirical research conducted within the project “Civil Law Protection of Citizens in the Financial Crisis – CitProtect”, opened two additional interesting topics. First, the compensation as the right of a bank in case of early repayment of a credit is considered. Finally, it is presented how the change of legislation has affected a change of the practice of the banks.
