Sažetak
In order to determine whether the measure, determined by the specified judicial judgments, was “necessary in a democratic society“, the Constitutional Court always assesses, if the reasons, the authorized courts have named to justify the measure taken, were relevant and sufficient regarding Article 8, paragraph 2 of the Convention. The term necessity implies a vital social need, and it is very important that the applied measure is proportionateto the legitimate goal which was wished to be achieved by the judgments.
