Sažetak
This article focuses on the example of the Union's youngest member Croatia to illustrate how the "formal" implementation of the directive as chosen by many new member states is likely to exclude from its applicability various situations which should be covered according to European case law. Departing from a brief review of this case law and its implications for assessing the compatibility of the Croatian implementation, the authors' analysis focus on the consequences of implementation shortcomings in the light of recent judgments on the question of horizontal effect of EU directives.
