Sažetak
This paper is presenting changes to the UCITS funds regulatory framework for depositaries introduced by the UCITS V Directive. These changes mainly concern the liability of the depositary and introduce new functions and responsibilities. They also bring rules on delegation of custody to third parties, on management of conflicts of interest and on which entities can act as depositaries . The paper then compares the UCITS V regime with the AIFMD regime. It also gives a critical overview of the amendments made to the UCITS Directive. Finally, it concludes by giving an overview of issues that remain unresolved.
