Sažetak
Despite the fact that all modern penal systems nowadays recognize many alternative sanctions, statistics show that prisons almost all over the world are overcrowded. Continuous lack of capacity in prisons leads to unbarable conditions which make the sentence even worse for the prisoners. In search for a solution of that important problem a few countries across the world have accepted a model of prison privatisation. The concept of private prisons is, however, very controversal one. Sharing one of the most traditional state prerogatives with private sector opens many arguable issues: ethical, social, economic, constitutional and criminal law etc. Republic of Croatia also deals with a quite huge problem of prison overcapacity. Statistical data of last couple of years is discouraging and shows that prison population is continuously growing. In this paper the autor will discuss the possibility of introducing a concept of private prisons in Croatian penal systems. By analysing pro et contra, he will give his oppinion is the prison privatisation suitable solution for prison overcapacity from Croatian perspective.
