Sažetak
This paper is devoted to the problem of rape and other forms of sexual abuse as the modality of war crime. It analyses the development of the concept of sexual offences as war crime, with a special emphasize on relevant case law of ad hoc tribunals for Yugoslavia and Rwanda and also International Criminal Court. In that sense, the paper discusses important details of the Akayesu Judgement (ICTR), Furundžija Judgement and Bemba Gombo Judgement (ICC). These three cases are the first rape cases before each of these courts. The second part of the paper will focus on Croatian criminal law. Croatian legislator incriminated rape as a part of actus reus of war crime in 2011.
