Sažetak
For the purposes of meeting general interests, expropriaton limits or revokes ownership which disrupts the balance between the general interests and the individual's fundamental rights. Compensation for expropriaton is an instrument used for establishing the aforementioned balance. In addition to the introductory part, which defines the legal nature of compensation for expropriaton and expropriaton object, this paper analyzes the method of determining compensation for expropriation under the new Expropriation and Determining Compensation Act, the Regulation for Real Estate Assessment and the Ordinance on Real Estate Assessment Methods, which together represent systematic regulation of the method for determining compensation expropriation. This paper places a separate emphasis on the Practice of the European Court of Human Rights in connection with the determination of compensation for expropriaton under the provision of Article 1 Protocol 1 to the European Convenction for the Protection of Human Rights and Fundamental Freedoms. In conclusion, this paper deals with cases of compensation for expropriation of illegally constructed structures and real estate that is considered expropriated.
