Sažetak
Basic human right is a right to life. Although this right is guaranteed by many international instruments (for example Art. 2 of the European Convention on Human Rights, Art. 2 of the Charter of Fundamental Rights of the EU) and should be standard for our civilization, the war on the territory of former Yugoslavia in the nineties showed fragility of the right to life, as well as the inability of domestic and international authorities to protect life and prevent killing. Central issue of the lecture is the analysis of the first judgement for genocide in Bosnia and Herzegovina rendered by District Military Court in Sarajevo on 12th March 1993 in the case of Herak, Damjanović and Tomić (No. K-I-14/93). In addition, we will also discuss some aspects of the conviction for genocide in the case of Jorgic v. Germany (App. 74613/01, Judgment 12th July 2007).
