Sažetak
The present legal opinion deals with the 2008 Draft Law on the Constitutional Court of Montenegro, which had been prepared by a working group established under the Ministry of Justice of Montenegro. The Draft Law is composed of 116 articles divided into five chapters. It addresses almost all relevant questions of a modern law of this type (general provisions, organisation of the Court, various proceedings before the Court, legal effect of the Court's decisions). The most welcomed is the introduction of a “full” constitutional complaint in Montenegro's legal order, including against individual acts and the reference to the European Convention on Human Rights to be taken into account. The obligation for other state authorities to take into account the legal reasons of the decision of the Constitutional Court when they adopt a new individual act is also a very positive element of this Draft Law.
