Sažetak
The importance of inter-municipal cooperation (IMC) for addressing modern-day challenges of local self-government systems has been steadily growing during the last several decades. Delivery of local public services has to meet ever growing standards (in quantity and in quality) put by the public and by national and supra-national legislation as well. One of the most vital prerequisites for successful inter-local cooperation is the establishment of an appropriate legislative framework as well as the creation of the coherent and efficient national policy on local government cooperation in general. This paper addresses theoretical concepts, different types and comparative trends of inter-municipal cooperation in order to build a framework for the analysis of different existing national legislative frameworks for the IMC: neutral (decentralized), enabling (stimulating) and comprehensive. Supranational regulatory trends concerning inter-municipal cooperation, formulated in legal and policy documents of the EU and the Council of Europe, serve as a starting point of the analysis. Elements and adequacy of national legislative frameworks for the IMC are analyzed according to local-government functions in various states and as depending on the structural features of local self-government systems (number of tiers, number of units in each territorial tier). In the last chapter, regulatory framework for the IMC in Croatia is analyzed, as well as the trends in IMC for the provision of local public services. Legislative landscape of IMC in Croatia is scarce and reserved, therefore unable to enhance consolidated and subsidiarity-oriented system of local public service delivery. Further legislative and policy improvements are suggested in order to promote and to facilitate inter-municipal cooperation as a mean of a more effective and more efficient public service delivery.
