Sažetak
While sexual violence have been neglected in international human rights law before the 1990s, in recent years growing human rights jurisprudence on rape has developed, primarily by the European Court of Human Rights (the Court). As the most effective international human rights mechanism, the Court has a significant role to play in securing justice for rape victims. While the Court has indeed contributed to setting up effective standards of rape prosecution, its jurisprudence also has limitations. This chapter analyses the potential and limitations of the Court’s jurisprudence on rape and offers suggestions for improvement.
