Sažetak
In this paper the author describes in detail the issue of the application of the Regulation on the liability of maritime passenger carrier in the event of a maritime accident (Regulation EC 392/2009), which implements solutions Protocol to the Athens Convention of 2002. in the European legal system. Prescribed solutions enabled the achievement of the objective stronger safety of maritime transport and better position of passengers, but also created a new, regional system of responsibility and obligatory liability insurance of the maritime carrier for death or body injury to passengers. In this paper it was performedthe legal effect of the Regulation EC 392/2009 on the European level, but also within the Croatian legal system, appreciating the fact that Republic of Croatia should be on 1 July 2013 become a full member of the European Union. Special emphasis of this paper is on the impact of the Regulation EC 392/2009 on the development of cruise tourism in Croatia, ie the negative connotation of the possible reduction in the number of cruises through the country because of the obligation of passenger ship to have insurance coverage (certificate of insurance or other financial guarantees) maritime carrier responsibility for damages - death or bodily injury of a passengers during their transport by sea. The aforementioned ships without the underlying insurance coverage will be prevented entry or departure to/from Croatian and other European ports, which will significantly affect the national economic system cruising destinations and slow down the further development of the global cruise tourism industry.
