Sažetak
The author begins by describing various international instruments, which affirm and protect the right not to be subject to torture. She points out that notwithstanding the general, longstanding and absolute prohibition of torture, the debate has emerged among legal scholars as to whether torture should be allowed in exceptional situations, commonly referred to as 'ticking-bomb' cases. The author proceeds to consider various arguments offered in favor and against the claim that torture should be regarded as permissible when its use could be the only means of obtaining the information capable of saving innocent lives of people against whom a violent crime is to be committed. Finally, having the broader theoretical context in mind, the author turns to analyzing the case law dealing precisely with the question of permissibility of torture in 'ticking-bomb' situations, in order to demonstrate which of the two opposing camps in the 'ticking-bomb' debate the courts have opted for in deciding those cases.
