Sažetak
A lot has been written in international legal and historical literature about Trieste’s crisis, the phenomena surrounding the relationship between Yugoslavia and Italy and the events taking place in these areas in the period immediately following the war. The author of this work, in particular analyses the subject from the international and juridical point of view, the Free Zone of Trieste which was established by the Peace Treaty with Italy in 1947 with the aim of solving the question of inter-frontiers, as a subject of international law. The work is based on classical definitions and conditions of subjectivity of international law, analysing juridical and real definitions of the FTT, without forgetting either of the principal arguments of the international law doctrine of the time (and in particular the Yugoslavian and Italian ones). The author concludes that FTT has, even though it contains many particularities, fulfilled the basic criteria needed for such an organisation relating to public law to be treated as a subject of international law, even though both the legal and historical truths have significantly complicated its functioning completely. The fact that during this procedure, FTT has fulfilled its task in a very complicated process of establishing the modern Italian – Croatian – Slovenian relationship is without question.
