Sažetak
Public participation in environmental issues is one of the most fundamental principles of global environmental governance. The involvement of the public is crucial to achieve sustainability. Adoption of the Aarhus Convention in 1998 marked a milestone in the development of environmental rights of the public. The Convention, although it only applies to the region of pan-Europe, has global significance. EU law should have been properly aligned with the provisions of the Convention with a view to its ratification by the EC in 2005. In order to achieve a comprehensive interpretation of environmental rights, a similar approach should be adopted in different legal systems. The judgment of the Court of Justice of the EU in Case C-240/09 (Lesoochranárske zoskupenie VLK) shows the indispensable role of the Court of Justice in the enforcement of the third pillar of the Aarhus Convention at national level, despite of the fact that the proposed directive on access to justice in environmental matters has not been adopted by the Council of the EU and the European Parliament.
