Sažetak
Interference into physical and/or mental integrity of the patient without informed consent is ethically and legally unacceptable. However, although the informed consent is accepted as an ethical imperative as well as is interlined into the Croatian legislation, existing legal norms for treating alcohol dependence is difficult to apply in medical practice. The author will consider the ethical, medical and legal aspects of informed consent from a general perspective as well as in the treatment of alcohol dependence. Also, informed consent legislation in Croatia will be reviewed, particularly: Convention on Human Rights and Biomedicine (ratified by the Croatian Parliament in 2003), Law on Protection of Patients' Rights (2004) and the Law on Protection of Persons with Mental Disorders (1997). Informed consent in delirium, for group therapy and treatment of minors where informed consent is important for resolving the issue of confidentiality will be discussed. In addition, responsibility of special professional groups involved in the treatment of alcohol dependence - doctors, nurses/technicians, psychologist, social workers - in connection with obtaining informed consent for treatment of alcohol dependence will be considered. Accordance with existing legislation in Croatia, the author will suggest direction for obtain the valid informed consent regarding to treatment of alcohol dependence and responsibility of defined professional groups.
