Sažetak
The Market Competition Protection Actof 1995 created a new legal framework for the protection market competition in the Republic of Croatia. Drafted in accordance with model of contemporary antitrust legislation, the MCPA introduces new provisions with regard to the content of protection of violated rights, as well as the realisation of such protection. As for as the procedural aspects of jurisdiction for unfair competition disputes from courts to administrative entities. This paper discusses the implications of that jurisdictonal transfer, especially in respect to the question of arbitrability of unfair competition disputes, and whether the new regulation in compatible with international standards.
