Sažetak
In this presentation, I explore the rape myths and gender stereotypes in the Croatian rape laws, as exemplified in the practice of the Zagreb County Court. I focus in particular on how the judges interpret the elements of rape and assess the credibility of the victim. In this respect, I examine how they define force, consent and resistance (elements of rape under Croatian law) and to what extent they inquire or allow inquiry into women’s sexual and private life, questioning how these interpretation in turn reflect and construct the dominant ideas about sexuality of women. I propose reforms in rape laws and practices which would allow for a more nuanced understanding of women’s (and men’s) sexualities, including adoption of a standard of affirmative (communicative) consent and stricter rules on sexual history, as well as changes in the culture and education of legal professionals.
