Sažetak
In this paper the author analyzes the issue of the existence of clausula rebus sic stantibus (CRSS) in Roman law, i.e. in the texts and cases discussed by Roman jurists, and the later influence of these texts. Special attention is given to the discussions (from the late 19th Century until today) relating to the identity and connection between the concept of CRSS and vis maior, on one side, vs. the idea of Geschäftsgrundlage as a successor to the medieval CRSS, on the other side. In the second part of the work the philosophical sources (works by Cicero and Seneca), used in the development of CRSS, are scrutinized from the legal standpoint.
