Sažetak
This paper focuses on the relevant theoretical and practical question of effective private enforcement of competition law in Europe, particularly on existing hurdles. Firstly it outlines specificities of competition law per se, following with providing insights in recent policy and legislative developments in the European union concerning private enforcement of competition law. Further on it reveals major obstacles on the road to full and efficient compensation of damages to any harmed individual. Moreover it concludes that the question of evidence is a most difficult obstacle to surpass, expressing arguments for the rationale. Finally the paper offers steps for necessary further research to be conducted in order to lessen current evidentiary hurdles, with the ultimate aim to establish, both on the EU and national level, a well functioning private enforcement of competition law to ultimate benefit of consumers.
