Sažetak
Freedom to provide services is one of the four freedoms in the EU internal market. Health services, although the least regulated, form a significant part of the cross-border services. Using its law-creating function, the ECJ responded to the needs of the market in a number of cases, such as Kohll, Decker, Geraets-Smits and Peerbooms and Müller-Faure and van Riet, which establish that medical services are covered by Articles 56 and 57 TFEU. The goal of the Directive on Services in the Internal Market 2006/123/EC is to create a shift towards the creation of a true internal market for services. Health services are a special kind of services with specific character within the health care policy. Their focus is on the citizen and social benefits (services) provided at national level. Freedom to provide health care services cross-borders includes the right of patients to receive health care in the Member State of treatment, under the same conditions as the citizens of that state.
