Sažetak
The topic of arbitrability still has to be taken seriously when drafting arbitration clauses. The issue of public policy, although not as important as it used to be, still plays a role in a whole range of jurisdictional matters. One of them is the notion of exclusive jurisdiction. Harmonization of rules on arbitrability is, however, rather hard unless one addresses the issue of exclusive jurisdiction within the basic parallelism between arbitrability and prorogability.
