Sažetak
Despite of the increasing number of alternative dispute resolution and no-fault liability systems a medical liability is still based on traditional civil law liability in continental Europe and tort law in common law jurisdictions. The patient is entitled to claim the damages if certain conditions are met and in general terms these conditions are universally accepted all over the world. One of the conditions for liability is wrongfulness, which in the field of medical liability can appear as medical error, infringement of informed consent duties, breach of health service contract or infringement of statutory duties.
