Sažetak
There is no erga omnes obligation relating as such to all States, based on general international law, to exercise universal criminal jurisdiction through their domestic judicial organs. In fact, that was not explicitly asserted even in the text of the above Resolution of the Institute of International Law. Unless assumed as a treaty obligation, it remains an option. On the other hand no State could lawfully complain about the exercise of this jurisdiction by other States when it is a matter of the prosecution of generally recognized international crimes, but subject to other requirements that were well formulated in the above Resolution of the Institute.
