Sažetak
In 1952, in its official observations on the preliminary draft of the Universal Copyright Convention prepared by UNESCO, Yugoslavia argued “that it is necessary to protect works of national art and that the copyright owner of these works should be the respective State”, detecting that “there is not only the problem of protection of the interest of the State to which the works of national art belong, but also of the interest of safeguarding their authenticity by means of judicious use of these works which have great cultural value for all mankind”. According to ethnomusicologist Marc Perlman, it is likely to be the first proposal ever for the legal protection of folklore on the international scale. In the first part of this paper I examine meanings, and political, cultural and scholarly foundations and context for this initiative. Then I draw comparisons with contemporary arguments regarding the legal protection of folklore, and the relationship between folklore and copyright. The debate has continued for decades within WIPO (World Intellectual Property Organization), as well as a number of scholarly disciplines, folklore studies and ethnomusicology among them. Scholars from post-Yugoslav states are not directly involved in these discussions. However, following some accents of this symposium (from its basic question of what to do with folklore, to pondering the relationship between folklore and borders), the discourses on the protection of folklore appears to be very much with us, albeit not empowered in legal terms. So, from the angle of intellectual property rights, I conclude the paper by revisiting the notion and status of folklore in scholarship and public sphere in Croatia, one of the successor states of the 1952 initiative.
