Sažetak
The Republic of Croatia is a country that has been facing, for several decades now, an extremely low birth rate and a negative trend of natural increase. The necessity of demographic reconstruction of the country as well as necessary measures in that direction have become a constitutive element of the programs' principles of most political parties. Therfore, last changes in the Labor Act of 2004 have been directed towards the increase of the birth rate and improvement of family protection. The protection of motherhood in Croatia unquestionably means the protection of the biological condition of women and represents a type of positive discrimination, i. e. affirmative actions, implicating at the same time, within the Croatian transitional context, a question whether the legal solutions have produced necessary effects or whether they have exposed women to further types of gender discrimination.
