Sažetak
Fifty years ago, the concept of compulsory insurance in maritime liability regimes was a brand new idea. It arose from the need of international community to protect those who might suffer damage caused in huge marine catastrophes. Today, functioning of marine trade and business could not be imagined without the concept of compulsory insurance. Croatian legislation follows the existing international liability and compensation regimes and introduces compulsory insurance in all relevant maritime categories. To experience the development and importance of the concept of compulsory maritime insurance, this paper gives full analysis of it through entire Croatian legislation on maritime insurance. Emphasis is put on the provisions of the Croatian Maritime Code, especially on its amendments of 2008. Beside the existing obligation to maintain insurance to cover liability in cases of oil pollution and nuclear damages, another two compulsory insurances are introduced – against bunker oil pollution and wreck removal. Provisions are compared with the solutions found in maritime liability conventions.
