Sažetak
Stabilisation and Association Agreement between Croatia and EU provides for the obligation on the side of Croatia to assess agreements that distort competition and abuses of dominant position on the basis of criteria arising from the application of EC competition rules. Although this issue was similarily regulated by the Europe Agreements the main crucial difference was that in this earlier variety of association agreements EC competition rules were not to be applied in a candidate country unless the Association Council brought decisions adopting the competition acquis. In particular in Hungary the Constitutional Court proclaimed that EC competition rules had not direct effect in Hungary.
