Sažetak
The unregulated legal status of the staff employed in local self-government units of the Republic of Croatia causes a number of practical problems and an unfavourable position of local government employees in relation to employees in public administration. In the context of the proposed reform of local self-government, it is necessary to provide for legislation which will regulate this rights, duties and responsibilities of local staff. Formally, this can be best accomplished by special legislation which would give a wide degree of autonomy in decision-making to local units, and at the same time establish the fundamental principles which integrate the territorial system of the Republic of Croatia into a whole. Restriction of the autonomy is justified for the purpose of promoting economy, equity and unity of the system, particulary with regard to legal protection and equality of the employed staff and citizens. The experiences of Scandinavian and post-socialist countries are compared and various possibilities for the creation of an appropriate legislative framework are proposed in the text. The analysis includes the issues of terminology and personnel records, the system of classification and remuneration, the system of promotion, employment and its termination, court protection, education, professional training, as well as some new tendencies in developed European countries. It is necessary to initiate wide and coordinated discussion on some of the mentioned issues among different protagonists (municipal and town representatives, trade unions, relevant ministries and other interest groups) so that the legislator could choose the best option. This particulary refers to the system of classification and remuneration, the system of promotion, court protection, as well as the strategy of education and professional training, in which it is important to provide conditions for the development of the study of public administration with a high educational level.
