Sažetak
The 2004 Road Transport Act does not have provisions concerning the contract of carriage by road, leaving a huge legal lacoon in the field of material law for the national carriage by road. This part of the legislation has been completely abolished from the Croatian transport legislation by the 2002 Amendments to the Carriage by Road Acr, with the incorrect arguing that this matter is covered by the Convention on the Corntract for the International Carriage of Goods by Road (CMR). The field of application of the CMR is exclusively international transport, and a national legal instrument is needed for the domestic transport.The 2005 Obligation Act in its provisions on contract of carriage, although revolutionary in its attempt to include basic principles of transport law in those provisions, des not provide a satisfactory level of protection of carriers' rights, leavig room for varioaus interpretation of its provisions in practice and legal incertanty for future operators in the Croatian road cabotage market, as well as their insurers.
