Sažetak
Because it poses particular problem when occurring in multi-state cases of over the internet the infringement of the IPRs has been a matter of meticulous study both in Europe (CLIP Group) and across the Atlantic (ALI). Some of these studies make part of the larger projects on the international jurisdiction, recognition and enforcement and applicable law in intellectual property cases. It is most interesting to compare the current draft projects (which are still ongoing) as well as to contrast these proposals with the legislative solutions included in the Rome II Regulation on the Law Applicable to Non-Contractual Obligations that is awaiting its adoption. Within such an analysis, the appropriateness of the locus protectionis rule has to be re-examined.
