Sažetak
The author discusses theoretical problems surrounding the adoption of the Constitutional Treaty for the EU. Three difficulties are pointed out. The fact that the EU is not yet a state while a constitution is always a constitution of a state. Second, the structural difficulty of a legal order that is not a legal order of the state. And third, the problem of democratic legitimacy where no homogenous people exists.
