Sažetak
Paper analyses the actual importance of confidentiality in arbitral proceedings and is primarily focused on confidentiality in relation to the parties in arbitral proceedings. After establishing the notion of “ confidentiality” in arbitral proceedings, the author gives an overview of comparative court practice and sources of law upon which the obligation of confidentiality can be based. Furthermore, the author determines the scope of application of the obligation of confidentiality in arbitral proceedings, possible exemptions from its application as well as sanctions for the breach of the obligation of confidentiality. Finally, objections that can be made against confidentiality as a principle of arbitral proceedings are discussed as well as the rationale for confidentiality in arbitral proceedings and the measures which the parties need to take in order to ensure the application of this principle.
