Sažetak
All countries so called countries in transition, after colaps of comunism in postcomunism period, have to transform legal system, which is in corelations with democratic civil society. This transition include regulation of free-market, regulation of human rights and protection, regulation of property etc. For the first this is materiae constitutionis, after that legal materia, and then materia for secondary legislation. Main problem in this period is so called inaugural effect, because then were contamination how to resolve social development - top down. It must be change by bootom up metodologie, which is fundamental spirit of civil society.
