Sažetak
This paper pleads for a radical implementation of probation in penological rehabilitation of adults. It elaborates experiences from abroad as well as objective and subjective pre-requisites for a successful implementation of probation in penology in general, and particularly the actual social conditions characteristic of the Republic of Croatia. The starting point is more than a thirty-year experience with probation of under-age persons in the Republic of Croatia and rich experience in the application of probation of adult offenders in the world. The main thesis is that the non-application of probation of adult offenders in Croatia has mainly been based on the lack of subjective pre-requisites, not the objective ones. The Republic of Croatia has relatively sufficient material and human resources for the implementation of inclusion in penology by way of protective control on parole. The author advocates a legal solution as to the system and organization, according to witch the probation of adult perpetrators of crimes would be entrusted on an institution witch is able to guarantee a high level of authoritativeness, organization and responsibility.
