Sažetak
The status of private archival records in Croatia is explained by comparing main principles of three archival laws, proclaimed before the Croatian independence in the year 1991, and new archival law proclaimed in the year 1997. The basic principles of previous laws such as protection of all archival records ; archival records protected also by the law on protection of cultural monuments, supervision of archives over privately owned records, the right of the first offer have been followed, with some additions. The new archival law for the first time introduces the terms of public and private archival records and private archives. It ca neb said that law treats in the same way public and private records and the provisions of the Law on public archival records are in an adequate way applied to creators and owners of private archival records if it is not otherwise regulated by the Law. Although the regulations of the law on private archival records owners’ obligations and related authority of archival service is clear, they are still not proved by and in practice. There are some questions that have to be answered: How the consultation of private archival records in scientific purposes, placed by its owners, will be regulated? Will the persons working in private archives have to be professional archivists? What will happened with archival records of dissolved private companies? It is beyond dispute that the whole country, its administration and archival service will have to gain experience with free economy, private property and private records. That experience is going to give birth to new laws and regulations on private archival records.
