Sažetak
Article VII (1) of the New York Convention provides parties with the possibility to take advantage of the provisions of national law and treaties that are in force in the country where an award is sought to be relied upon. Regarding the formal validity of the arbitration agreement, Article II (2) has to be read in conjunction with the more favorable right provision of Article VII (1). This creates a situation where the 'in writing' requirement of Article II (2) can be derogated from, providing that courts can apply less stringent formal validity requirements of internal law. Although one can only speculate on whether national courts will interpret Article VII (1) in a way that would eventually uphold the simultaneous application of national law and the New York Convention, the paper explores to what extent such an interpretation promotes the Convention's goal of facilitating recognition and enforcement of arbitral awards.
