Sažetak
The paper explores the social and legal status of religious communities inside the Croatian transitional circumstances. It firstly gives an overview of historical background, social policy transformation and basic religious structure, facts which are important for understanding of all legal and social controversies about the new position of religious communities. New legal system is analyzed through new constitutional provisions and agreements signed with the Holy See. The process of the drafting of the new law on religious communities presents a ground for the study of position and interest of different social groups involved. An absence of any meaningful debates is particularly noted as well as a fact of influential debates provoked only by narrow interests of media or particular social/political/religious groups. New law, which is passed in the Croatian Parliament in 2002, brought new conditions for the process of official registration of religious communities. Although very critical to the process of drafting the new law, and evident lack of public interest in the question of social and legal rights of different religious communities, the paper argues that the Croatian situation is more similar to other Central European countries than to Russia or some other post-Soviet countries where very serious restrictions of religious rights has occurred. It also warns, based on recent experience of some Western European countries, that a developed democracy and political and social stability are not guarantees that there will be no problems in respecting religious freedom.
