Sažetak
After almost fifty years of coexistence in the former Yugoslavia, Croatia gained independence in 1991. After such social and political changes and enactment of the young states Constitution, there inevitably followed a legislation reform and substitution of all laws still in power and enacted before 1990. This was about the family law as well.
De lege lata family relations in Croatia are regulated by the Marriage and Family Relations Act, enacted in 1978. The Act was amended in 1989. So, it is a law that was expected to be amended.
The new Family Act Bill was made in May of this year. Following introductory clauses, it contains provisions related to marital rights, the relations between parents and children, adoption, guardianship, support, property-right relations and, finally, the procedure before courts and administrative bodies. All good provisions of the present Marriage and Family Relations Act have been preserved. New provisions reflect tendencies towards more detailed legislation and making particular legal institutes more up-dated, and their harmonization with numerous international (global and regional) documents provisions.
I would like to point out only the changes brought by the new Act regarding arrangement of marriage and other forms of family life (such as unmarried couples, family based on adoption and family created with medical assistance).
