Sažetak
Ten years after the decision of the Institute of International Law (IDI) at its Milan Session to select "humanitarian assistance" as the subject for its Sixteenth Commission, it is important to point out the always-increasing relevance of humanitarian assistance for mitigating the sufferings of large segments of the population in many countries. There is an abundance of texts containing principles/rules relevant to the subject - various instruments adopted by intergovernmental and non-governmental organizations, documents drafted by experts and even municipal rules. Principles contained in these documents range from already confirmed international legal rules - some of them being even of a "ius cogens" nature - to soft law, or only suggestions for new international rules. The present reports discuss questions such as definition and terminology concerning the subject, situations requiring humanitarian assistance, sources of rules on humanitarian assistance, the right to humanitarian assistance and the duty to provide it, the duty of states to admit humanitarian assistance, etc. The draft resolution on humanitarian assistance prepared by the rapporteur is appended to his final report. The resolution on humanitarian assistance was adopted at the Bruges Session of the IDI in August/September 2003.
