Sažetak
Apart from the general duty to protect archaeological and historical objects (Article 303(1)), in the UN Convention on the Law of the Sea there are no specific provisions regarding underwater cultural heritage (UCH) found on the continental shelf, i.e. in the EEZ. During the negotiations for the 2001 UNESCO Convention on the Protection of the Underwater Cultural Heritage (UCHC), the initial proposal to extend coastal State jurisdiction to the protection of UCH in the continental shelf/EEZ was met with strong opposition from major maritime States. The resulting compromise is a complex reporting and consultation mechanism based on inter-State cooperation.// The UCHC’s State cooperation mechanism has now been initiated for the first time in respect of the Skerki Bank archaeological site, located in the Mediterranean between Sicily and Tunisia. In 2020, a coordination committee was formed under the auspices of UNESCO, gathering the eight Mediterranean States, including Croatia, that had expressed their interest in joining the consultations. The first achievement of the process has been the successful completion of a survey mission conducted in August and September 2022. Thus, the paper aims at presenting first findings concerning the application of the UCHC’s rules on the State cooperation mechanism in practice.
