Sažetak
After more than a decade of discussions and preparatory work in the framework of the United Nations, in December 2017 the time was finally ripe for the General Assembly to convene the Intergovernmental Conference (IGC) on ‘an international legally binding instrument under the United Nations Convention on the Law of the Sea on the conservation and sustainable use of marine biological diversity of areas beyond national jurisdiction’ (BBNJ Agreement). To complete the IGC’s task in the course of four sessions, as initially provided, has proven too ambitious. Hence, an additional fifth session of the IGC has been convened for the second half of August 2022, at which the text of the future BBNJ Agreement should be finalised. In the resolution laying out the mandate of the IGC, the UN General Assembly reminded, inter alia, that the future BBNJ Agreement had to be “fully consistent” with the 1982 UN Convention on the Law of the Sea. Therefore, taking into account the current status of negotiations, it is the aim of the paper to assess how this requirement has been considered in the text of the BBNJ Agreement and to endeavour some further elaboration on the interplay between the UN Convention on the Law of the Sea and the BBNJ Agreement, once adopted and in force.
