Sažetak
Over the years, the Republic of Croatia has developed a relatively good constitutional and institutional framework aimed at establishing gender equality. As one of the constitutional values of the Croatian constitutional order and a ground for interpretation of the Constitution, gender equality is protected by the Constitution, special anti-discrimination laws and other laws containing anti-discrimination provisions. The existing constitutional framework has been accompanied by a solid institutional framework headed by the Ombudsperson for Gender Equality. The purpose of this chapter is to give an overview of the legislative and institutional framework of gender equality in Croatia and to identify existing gaps and challenges in its implementation. We focus on five important constitutional moments in this context: the adoption of the Constitution (1990), the Revision of the Constitution (2000), the adoption of the (second) Gender Equality Act (2008), the Constitutional Court Decision on abortion (2017) and two citizens’ initiatives: to amend the definition of marriage in the Constitution (2013) and to repeal the Istanbul Convention (2018). After that, we try to prove that despite the relatively well-developed constitutional and institutional framework, numerous challenges and problems in the implementation of gender equality standards are still evident in many fields. Finally, our conclusion aims to sum up the challenges and opportunities to achieve the desired objectives of gender equality in Croatia.
